Question: I think I need to go bankrupt. I can’t make my payments anymore because I spent too much money. I bought clothes, collectible wrist watches, guns and hunting trips.
I went to auctions to buy Rolex and Cartier watches for my collection, I bought clothes at the mall and had about 15 suits handmade and I went to auctions and bought guns and I went hunting in South Georgia where I killed some pigs and took some major bucks.
It was all fun but the money has added up and the debt is huge and so I need to file bankruptcy. My accountant said the best thing to do when you have too much debt is to file bankruptcy because that gets rid of it and then I can start my life again with my new girlfriend.
I grew up without much money in Macon, GA. Then I moved to Atlanta for a job at the airport and now I live in Johns Creek. I was married but my wife left because of my bipolar and drug issues. I was using pills because I got addicted when I had a back injury from playing tennis.
Now I’m getting calls all day and I don’t think they are going to stop until I do what I need to do. I tried to borrow money from my sister but she doesn’t have much money now. I thought she was rich so I was surprised to hear that she and her husband, who’s a doctor, filed bankruptcy two years ago. I didn’t know doctors filed for bankruptcy.
Please tell me when I can file and what type of bankruptcy I qualify for. I need help and I’d like to schedule a consultation to talk about getting debt relief.

Answer: We will do a financial assessment for you to determine if you qualify for a chapter 7 or a chapter 13 bankruptcy. A chapter 7 will discharge (wipe-out) all of your debt. Basically, the only debts that you can’t get rid of in a chapter 7 are child support payments, student loans and IRS debt (although if the tax debt is more than 3 years old, it may be dischargeable).
Or you may qualify for a chapter 13 bankruptcy. Under a chapter 13, you pay back a portion of your debt, usually over 5 years. As bankruptcy attorneys, we seek to minimize what you would have to pay back in your chapter 13.
We can file bankruptcy for you very quickly. Let’s schedule a consultation and we’ll explain exactly what you need to do to get a bankruptcy filed as quickly as possible.
