“Can I File Bankruptcy if I’m Not a U.S. Citizen?”

Woman and papers

Question: I am not an American citizen. I am a green card holder. I must file for bankruptcy. I lost my job at a restaurant and I started using my credit cards too much. I used my credit cards to buy food, pay my rent and buy gasoline. I used credit cards for everything. I also got personal loans so that I could pay for things. My wife did the same things with her credit cards. She is also an immigrant and is not now a citizen. She is not a green card holder. We both want to be citizens but we have a ton of debt.

We don't spend a lot of money on things like rent, cars, food or entertainment. We don't live large.

After I lost my job I started a business with a friend. We did landscaping and pool work and tried to open a Mexican restaurant. Now I am getting sued and I need to file a bankruptcy. But I don't know if I can file bankruptcy because I am not a U.S. citizen. Can I file if I am not a citizen? What can I do?

Answer: Don't worry; you do not have to be an American citizen to file bankruptcy. Many non-citizens file bankruptcy. Bankruptcy is provided for in the United States Constitution and citizens and non-citizens alike are able to file.

We have filed bankruptcy for immigrants from around the world. We have filed for clients from countries such as Mexico, Canada, France, Germany, Argentina, Brazil, Peru, China, Japan, Korea, Nigeria, South Africa, Egypt, Iran, India and Pakistan, to name just some.
