Question: I got arrested for DUI in Cumming, Georgia, over the weekend. I work all the time and I want to know if I have to go to court or if I can get a DUI attorney to appear for me so I don’t have to be there.
I travel for work about 25 days a month. Sometimes I have to travel to other countries, but mostly I’m in California, Arizona, Colorado and Nevada, because that’s my territory. I sell software and I relocated to Georgia from California to be closer to my parents, who own a store in Buckhead.
I was driving home after spending time at the lake and I was stopped because I didn’t have my headlights on. It wasn’t even my car. My sister let me use her vehicle while mine is in the shop for repairs.
So because my lights were off the cop stopped me and I took the tests, including a breath test near my car. Then, after I said I’d had a few beers, the cop arrested me. It’s my first DUI ever. I haven’t even been arrested except for once in college for underage drinking.
Since I work so much I was hoping that I don’t have to go to court and maybe a Forsyth County DUI lawyer can appear for me.

Answer: You don’t say if you were arrested by a Forsyth County deputy sheriff, a Georgia State Trooper or a City of Cumming police officer. If you were arrested by a deputy sheriff you will have to go to court at the Forsyth County State Court; if you were stopped by a Cumming police officer, then you will have to go to the Cumming Municipal Court.
Either way, however, you will have to make at least one appearance in court. DUI cases are not handled by a plea in absentia. A plea in absentia is a plea that is entered without an appearance in court by the defendant. For a drunk driving charge, you do have to appear. But at least in many cases you will only have to appear once.
