Alpharetta DUI: When can I go to jail?

Question: I got another DUI. This time it was in Alpharetta. I've had a few of these and I know I need some help. I'm going to start going to AA meetings and possibly an inpatient rehab.

I was driving on Windward Parkway and turned onto Alpharetta Highway. That's when I got stopped for speeding. The Alpharetta cop said I was 30 miles per hour over the sped limit. I know I was speeding but it really wasn't that fast. I was drinking at Taco Mac and had some hot wings too. I had a number of craft beers. I didn't think I was that drunk. I only felt buzzed.

The cop had me take a blood test. I have recently used cocaine and some OxyContin that I got from my friend's grandmother. So I think I'm in some trouble.

I want to know if I have to go to jail in Alpharetta, do I have to go right then from court. Or can I go to jail later. I need to know because I'm a dentist and I need to make arrangements with my office.

Answer: Whether you can report to jail or not is a question for your DUI lawyer to discuss with the Alpharetta solicitor, Fran Shoenthal. The solicitor can insist on immediate detention, or she can agree that you can serve any jail time starting at a later date, perhaps a week or even two weeks later.

We have worked with Ms. Shoenthal on many occasions to have jail time served at a later date. When the plea is entered to the DUI charge, the Alpharetta judge requires that a date and specific time to report to jail be placed on the sentencing sheet.
