DUI Probation Question

Question: I have some questions about my husband's probation in Sandy Springs. He's on probation for DUI at the Sandy Springs Municipal Court and he hasn't made all his payments for his fine. I know he has the money to make the payments, but he just hasn't made all of them. He'll make a partial payment sometimes to his probation officer.

I'm worried that this will lead to his probation officer taking actions that will hurt him. He's been on probation for about 4 months and his probation officer said that if he doesn't pay he could face a probation violation. He doesn't think you can get a probation violation charge just because you don't pay the fine.

I think he's using the money for gambling debts that he got from a poker game and from going to Las Vegas for two weeks. He lost a lot of money betting on sports. I think he's a gambling addict and has a drinking problem. It wasn't his first drunk driving charge.

This doesn't sound right to me. Can he get a probation violation because he has not paid his fine?

E.M. in Sandy Springs, GA

Answer: Yes, he can be charged with a probation violation for not paying fines. In fact, this is a common reason for a probation violation. Sandy Springs, like other municipalities throughout Georgia, takes seriously the monetary component of a DUI sentence. If he doesn't pay, he could face jail time.

Please call us so we can try to intervene with his probation officer to settle the matter.
