We both work for a large Japanese company. My boss is Japanese and was just visiting our company's headquarters in Alpharetta. We went out for the night and had sushi, sashimi and a lot of Japanese beer, wine and whiskey. It was a blast. The company picked up all the costs and we were a large group so it was pretty expensive. My boss definitely likes to drink.
I thought he was going to get a ride back to his hotel in Atlanta. But he actually tried to drive a car. That's when he was arrested in Marietta. He took the breathalyzer test and it was .243, which I know is very high.
It wasn't his first DUI. Actually, it was his second DUI. He got his first DUI about seven years ago when he visited us for an inspection of the offices. That DUI was in Gwinnett County. My boss is very worried. He wants to know about how much community service he might have to do. And can he do the community service in Japan?
Answer: In Cobb County State Court, he will likely have to perform 240 hours of community service. Usually, for a second DUI conviction, a defendant has to perform 240 hours of community. Some courts may require a defendant with a second conviction to do even more.
As for his ability to do some or all of it in Japan, that would be up to his probation officer. We have had clients from other states and countries who have been allowed by their probation officers to perform their community service outside of Georgia. Probation would, of course, require that they furnish proof that the community service was fully performed.
